Pozew dotyczy naruszenia dóbr osobistych i nakazuje przeproszenie pozwanego na stronie internetowej elpais.com. W marcu br. na stronie internetowej El Pais, największego hiszpańskiego dziennika, pojawił się artykuł „Polonia reescribe su historia de la Il Guerra Mundial”, z którego wynika, że Polacy są odpowiedzialni nie tylko za Holokaust, ale również za „pogromy Żydów” czy też „polowania na Żydów”. Autor artykułu w swoich wypowiedziach powołuje się m.in. na Jana Grabowskiego i Jana Tomasza Grossa. W hiszpańskim tekście pojawiły się konkretne tezy, o których sprostowanie Reduta Dobrego Imienia prosiła wydawnictwo w piśmie datowanym na 12 kwietnia (poniżej tłumaczenie fragmentów artykułu El Pais):  1. 9000 strażników z Auschwitz, prawie samych Niemców, co wzbudza wątpliwości wśród historyków 2. Polska od lat stawia czoła temu dylematowi: była ona jednym z krajów, które najbardziej ucierpiały podczas drugiej wojny światowej, ale jednocześnie, w czasie trwania konfliktu, obywatele polscy dopuszczali się na Żydach okrutnych czynów 3. Opowiada również o tak zwanych Judenjagd, inaczej polowaniach na Żydów, w których udział brali niemal zawsze Polacy, od strażaków po wieśniaków. Według Grabowskiego, zamordowano w ten sposób ponad 200 000 Żydów  4. W Polsce było bardzo mało współczucia dla Żydów, którzy byli masowo mordowani, a ludzie, którzy zaryzykowali ich ukrywanie, narażali się przede wszystkim na możliwy donos ze strony swoich sąsiadów    Wydawca portalu do chwili obecnej nie zareagował na pismo. - Ten artykuł został bardzo negatywnie odczytany przez polskie społeczeństwo, wywołał oburzenie. Polacy ratowali Żydów, często narażając własne rodziny, a informacje przytaczane w tekście nie są potwierdzone faktami. Jestem z wykształcenia historykiem i nie zgadzam się na tego typu kłamstwa o Polsce i Polakach – mówi Maciej Świrski, założyciel Reduty, który jest powodem w niniejszej sprawie. Bez wątpienia jest to sprawa precedensowa. Do tej pory w Polsce były rozpoznawane pozwy o tzw. „polskie obozy koncentracyjne”, jednak tekst El Pais idzie dalej – mowa tu o aktywnym udziale Polaków w morderstwach Żydów podczas II wojny światowej. Tego typu komentarze wprowadzają w błąd ludzi, którzy słabo znają historię Polski lub też w ogóle jej nie znają. - Uważam, że mówienie o winie Polaków i ich odpowiedzialności za II wojnę światową, jest naruszeniem dobra osobistego nie tylko mojego, ale każdego Polaka. Takie tezy przedstawiają bowiem każdego Polaka jako potomka morderców – a na to naszej zgody być nie może – dodaje Świrski. W pozwie jest wniosek o przeprosiny i sprostowanie informacji przedstawionych w tekście. Jednak w zależności od odpowiedzi dziennika prawnicy zanalizują sytuację pod kątem ewentualnego zadośćuczynienia. Wówczas jednak konieczne będzie opłacenie wpisu sądowego, który wyniesie 5% od wnioskowanego zadośćuczynienia. Proces będzie toczył się w Polsce. - W tej chwili można pozywać dzienniki, zwłaszcza te wydawane w wersji elektronicznej, przed polskimi sądami. Oznacza to, że polski sąd rozpozna sprawę w Warszawie i według polskiego porządku prawnego. Nawet jeśli druga strona będzie chciała powołać świadków – np. Hiszpanów - to w świetle Rozporządzenia Rady (WE) 1206/2001 – a konkretnie art. 17 - istnieje nie tylko możliwość telekonferencji, ale nawet wyjazdu polskiego sądu (polskiego sędziego) do Hiszpanii i zadawania tam – na miejscu pytań do świadków lub stron. Nie ma więc dziś absolutnie żadnych przeszkód by rozpoznawać to według naszego porządku prawnego – mówi mec. Monika Brzozowska–Pasieka, reprezentująca Macieja Świrskiego.
