Friends this is a lengthy email but I hope you'll read it through. You may have seen the reporting about Trump Supreme Court nominee Neil Gorsuch’s meetings with some US senators in which he supposedly expressed concern about Trump’s repeated attacks on the judicial branch using words like “demoralizing” and “disheartening.” To any senator -- or anyone, period -- who believes that this indicates some sort of moderate thinking or will mean that Gorsuch won’t be a rubber stamp for Trump’s unconstitutional agenda, well, as they say, I have a bridge to sell you.PFAW’s Communications Director Drew Courtney was quoted in the Washington Post this week setting the record straight:
“Is Gorsuch distancing himself from Trump? As we say on the Internet: LOL. To be clear: Donald Trump's pattern of attacks on federal judges is more than demoralizing -- it's a threat to the separation of powers and our constitutional system, and it's hard to imagine a more tepid response than to call them 'disheartening.'"
Let’s be clear: if any senator truly believes in the constitutional rights and values they say they do, then allowing Gorsuch to be confirmed is simply not an option.
Gorsuch’s extreme legal philosophy -- to the right of Scalia in key areas -- consistently leads him to conclusions that benefit corporations and the powerful over the interests of everyday Americans. At the same time, he denigrates liberals for using the courts to vindicate core constitutional rights, for example the right of LGBTQ individuals to equal treatment under the law.
We’re working hard to make the truth about Neil Gorsuch undeniably clear. And we’re turning up the pressure on Democrats and Republicans alike to prevent confirmation of someone who would move the Court even further to the right.
But we need your help in this work, STJEPAN.
That’s why I’m asking that you make your 2017 renewal contribution now, to support our emergency campaign to BLOCK the confirmation of Neil Gorsuch.
Our efforts are already paying off.
We have an unprecedented eight US senators who have already come out in opposition to Gorsuch, and every Democrat has remained publicly committed to giving this nominee the intense scrutiny his record demands and to their support of the 60-vote threshold needed to confirm the most important lifetime appointment there is.
Amazingly, we’re even getting some help from the most unlikely of places: the White House. Trump’s assertions that reports about Gorsuch being “disheartened” are “fake news” and his impulsive outbursts against the senators who have disclosed Gorsuch’s comments seem to be only hurting his nominee’s chances, as some Republican senators are now reportedly saying they’re worried about getting the 60 votes they’ll need to advance his confirmation.
An aide to Minority Leader Schumer was quoted in The Hill newspaper saying, “[White House Press Secretary] Sean Spicer just made it crystal clear that Judge Gorsuch has refused to condemn President Trump's attacks on the judiciary. That makes an already weak response even weaker, and is further proof that the judge has not demonstrated the kind of independence necessary to be a check on the administration.”
- We’re on the air with a TV ad -- that’s been getting fantastic reviews -- in 14 target states making the case against Gorsuch.
- We’ve brought on staff in top tier targets West Virginia and Montana, and are working with allies on the ground to organize events in Florida, Pennsylvania, Wisconsin, and more states.
- We're successfully working with state and local leaders to place op-eds and letters to the editor of newspapers in key senators’ states.
- We’re sharing our research with senators and their staff -- including information on Gorsuch’s extreme pro-corporate record -- as well as helping to put together daily talking points for coalition partners and churning out reports and legal analysis that have made our team the go-to experts on some of the most concerning issues in Judge Gorsuch’s record.
Help us keep the momentum going!
Judge Neil Gorsuch was one of the most conservative on Trump’s list of unacceptably conservative potential nominees, supplied to him by far-right organizations like the Heritage Foundation. But even using that word, “conservative,” normalizes Trump and normalizes right-wing extremism.
What the Gorsuch nomination really is is a gift to the most radically right-wing factions of Trump’s and the GOP’s base.
The judicial philosophies of justices like Clarence Thomas, Samuel Alito, and, perhaps even more so, the late Antonin Scalia -- whose mold Gorsuch is said to most fit -- are not merely “conservative.” They are extreme and far to the right of anything that was considered remotely mainstream before the Reagan era, when right-wing legal thought went off the deep end with the rise of judges like the rejected Supreme Court nominee Robert Bork and Scalia himself.
As dangerous as Trump and his right-wing congressional majorities are to our democratic institutions and our constitutional system of checks and balances, Gorsuch would be as dangerous to Americans’ fundamental rights, the public interest, our bedrock democratic principles, and, yes, to checks and balances. A Court as far to the right as Neil Gorsuch would NOT be a check on the Trump administration or on the overreach of this Tea Party Congress. The stakes are as high as they’ve ever been and we need to rise to the challenge. The only way we’ll do it is together. Please renew with a donation of $7 or more to our campaign to stop Gorsuch now>> Thank you for your dedication to the defense of democracy, equality, and justice for all -- the American Way.
