This morning, in the midst of day three of Supreme Court nominee Judge Neil Gorsuch's confirmation hearing, news broke that the Court to which he is nominated UNANIMOUSLY rejected an important ruling he issued. In 2008, Judge Gorsuch ruled against a child with autism, writing that to fulfill the Individuals with Disabilities Education Act a school only needed to show that a student had made "merely more than de minimis progress." The Court he hopes to join, however, unanimously said this bar is way too low.When Senators Dick Durbin and Amy Klobuchar questioned Gorsuch on the new ruling, he dodged the questions left and right. Instead of saying why he ruled the way he did, he referred back to what was in fact a misreading of precedent, and ignored the actual question asked of him. Gorsuch's lack of concrete answers to questions has been an ever-present thread in the hearing -- and being unable to tell us why he rules the way he does is another reason that disqualifies him. Crucial information to understand Gorsuch and his nomination came out the past two days. Here's what we've written:
- According to Sen. Franken, Gorsuch's dissent in the 'frozen trucker' case was "absurd."
- Listen to our telebriefing where Senator Elizabeth Warren called Gorsuch "corporate America's flunky."
- Today, the Supreme Court unanimously rejected Gorsuch's standard in a disability rights case. Awkward.
- And Gorsuch kept ducking questions about why he rules the way he does and what he believes.
- Senator Al Franken raised the issue of the Roberts Court constantly ruling for corporations and against workers and consumers.
- Yesterday, Senator Sheldon Whitehouse slammed 'dark money' in politics.
