Aplikacija je napravljena na inicijativu Hrvatske zajednice županija.
 

Petrov: Ciljne kontrole putnika umjesto nepreglednih kolona na granici

Uredba o nazivima radnih mjesta i koeficijentima složenosti poslova u javnim službama

Uredba je izmijenjena.

Uredba o izradi i provedbi dokumenata Strategije upravljanja morskim okolišem i obalnim područjem

Izmjenama i dopunom Uredbe se, među ostalim, propisuje da Ministarstvo o Skupu ciljeva i s njima povezanih pokazatelja za morski okoliš obavještava Europsku komisiju putem Agencije za zaštitu okoliša u roku tri mjeseca od datuma njihova donošenja.

Pravilnik o postupanju s privremeno oduzetim predmetima, domaćim ili stranim sredstvima plaćanja, vrijednosnicama i dokumentacijom

Pravilnikom se propisuju načini postupanja s privremeno oduzetim predmetima, domaćim ili stranim sredstvima plaćanja, vrijednosnicama i dokumentacijom u postupcima koje vodi Ministarstvo financija, Porezna uprava iz nadležnosti primjene poreznih i s njima povezanih propisa.
Pravilnik stupa na snagu 29. travnja 2017.
 

Pravilnik o obavljanju poslova, uvjetima i načinu za izbor te oduzimanju izdanog odobrenja za obavljanje poslova depozitara obveznog mirovinskog fonda

Izmjenama i dopunama Pravilnika se, među ostalim, propisuje da Agencija može, u slučaju potrebe, zatražiti od depozitara dostavu određene dokumentacije propisane ovim Pravilnikom i u izvorniku ili ovjerenoj preslici, neovisno o izvršenoj dostavi u elektroničkom obliku.

Odgovornost za naknadu štete počinjene od pasa ili mačaka lutalica

U domaćoj pravnoj praksi, doduše mnogo rjeđe nego u nekim drugim državama i gradovima, javlja se materijalnopravno pitanje odgovornosti za naknadu štete koju oštećenicima počine psi ili mačke lutalice. 
Stoga ćemo prezentirati mjerodavne propise koji reguliraju ovu materiju i na temelju njih identificirati pravne subjekte deliktno odgovorne za naknadu štete kod takvih štetnih događaja te naznačiti moguće kriterije njihove odštetnopravne odgovornosti.


Je li verbalni sukob između radnika razlog za izvanredni otkaz?

Izvanredni otkaz, kao jedan od načina prestanka ugovora o radu, propisan je u članku 116. Zakona o radu. Pri donošenju odluke je li neka situacija na radu ili koja je vezana uz rad takve težine da upravo zbog nje, a uvažavajući sve okolnosti, radni odnos između radnika i poslodavca ubuduće više nije moguć, od pomoći može biti sudska praksa i mišljenja nadležnog ministarstva.

Načelo ne bis in idem s aspekta zaštite ljudskih prava

Načelo ne bis in idem jedno je od temeljnih načela gotovo svakog modernog pravnog sustava. Autorica daje prikaz konkretne sudske praske domaćih i međunarodnih sudova, posebice Europskog suda za ljudska prava, u pogledu primjene načela ne bis in idem kod procesuiranja najtežih kaznenih djela protiv ratnog i međunarodnog prava, a nakon primjene odredaba o oprostu za ta ista kaznena djela.
 

Ovršni postupak prema novom Općem poreznom zakonu - 1. dio

Ovršni postupak u poreznim predmetima u Republici Hrvatskoj uređen je Općim poreznim zakonom (NN 115/16) koji se primjenjuje od 1. siječnja 2017. 
U članku autor, radi boljeg shvaćanja mjesta i uloge ovrhe na nekretninama unutar općega poreznog ovršnog postupka, daje prikaz osnove ovršnog postupka, a potom detaljnije pristupa obradi ovršnog postupka nad nekretninama.

Ako trošarinski obveznik smatra da činjenično stanje nije pravilno utvrđeno, tome mora prigovoriti na licu mjesta jer neke dokaze, poput utvrđivanja količine duhana, nije moguće kasnije izvesti - Visoki upravni sud Republike Hrvatske,
broj odluke Usž-3227/16-2 od 5. listopada 2016.
 

Poslovno uvjetovani otkaz ugovora o radu

Ako poslodavac otkaže radniku ugovor o radu zbog gospodarskih, tehničkih ili organizacijskih razloga, a nakon toga zaposli na istim poslovima drugog radnika, tada to ne predstavlja razlog zbog kojeg je poslodavcu nedopušteno otkazivanje ugovora o radu već predstavlja teži prekršaj poslodavca propisan Zakonom o radu - Vrhovni sud Republike Hrvatske, broj odluke Revr 322/13-2 od 3. prosinca 2014.

IUS-INFO - Postupak izvršenja presuda Europskog suda za ljudska prava pred domaćim tijelima


Republika Hrvatska stranka je Konvencije za zaštitu ljudskih prava i temeljnih sloboda od 5. studenog 1997.
Ratifikacijom Konvencije i priznavanjem jurisdikcije Europskog suda za ljudska prava u svim predmetima koji se tiču tumačenja i primjene Konvencije, Republika Hrvatska prihvatila je međunarodnu obvezu primjenjivati Konvenciju i pravne standarde koje u svojoj praksi izgrađuje ESLJP u postupcima pred domaćim tijelima, ali i obvezu izvršiti konačnu presudu ESLJP-a u kojoj je utvrđena povreda Konvencije.
Presude ESLJP-a obvezuju državu na koju se odnose. Za izvršenje konkretne presude ESLJP-a nadležno je ono državno tijelo koje je svojim radnjama ili propuštanjem uzrokovalo povredu Konvencije u konkretnom slučaju, ali i tijelo u čiju nadležnost ulazi neko od pitanja koje je presudom ESLJP-a označeno kao jedan od uzroka povrede Konvencije.
