Vještačenje u upravnom sporu

Člankom 33. Zakona o upravnim sporovima određen je način utvrđivanja činjenica u upravnom sporu na način da je kao temeljno pravilo postavljena slobodna ocjena dokaza, a ujedno je određeno da Upravni sud uzima u obzir činjenice utvrđene u postupku donošenja osporene odluke, kojima nije vezan, i činjenice koje je sam utvrdio. 
Dokazi su: isprave, saslušanje stranaka, iskaz svjedoka, mišljenje i nalaz vještaka, očevid i druga dokazna sredstva, a izvode se prema pravilima kojima je uređeno dokazivanje u parničnom postupku.
 

Oporezivanje građevinskog zemljišta

Oporezivanje isporuke nekretnina u hrvatskome pravnom sustavu uređeno je Zakonom o porezu na promet nekretnina i Zakonom o porezu na dodanu vrijednost
U članku ćemo se ukratko osvrnuti na neke posebnosti isporuke građevinskog zemljišta i plaćanje pripadajućeg poreza na obavljenu isporuku nekretnine.

Revizija za potrebe Agencije je postupak provjere i ocjene stanja i promjena tehničkih pričuva te stanja i strukture ulaganja imovine za pokriće tehničkih pričuva prema računovodstvenim propisima, pridržavanja pravila o upravljanju rizicima, obavljanja poslova ključnih funkcija, stanja informacijskog sustava i adekvatnosti upravljanja informacijskim sustavom, pravilnosti, točnosti i potpunosti izvješća koja se dostavljaju Agenciji, točnosti i potpunosti izvješća o solventnosti i financijskom stanju društva za osiguranje.
 IZBOR IZ SUDSKE PRAKSE

Postupak pred prvostupanjskim sudom - prekid postupka - po odluci suda - obvezni

Jesu li tuženi radnici prouzročili štetu poslodavcu (tužitelj) kaznenim djelom počinjenim namjerno prethodno je pitanje od kojeg ovisi odluka parničnog suda o njihovoj solidarnoj odgovornost za tu štetu - stoga kada je protiv njih pokrenut kazneni postupak u kojem im se na teret stavlja izvršenje takvog kaznenog djela parnični sud će odrediti prekid postupka, jer o tome je li šteta učinjena kaznenim djelom ovlašten je odlučivati samo kazneni sud - Županijski sud u Bjelovaru, broj odluke Gž R-111/15-2 od 10. prosinca 2015.
 

Apsolutna nenadležnost suda

Općinski sud nije nadležan odlučiti o pravu stranke na invalidsku mirovinu - Vrhovni sud Republike Hrvatske, broj odluke Rev 911/12-2 od 22. travnja 2015.
 NAJAVA DOGAĐAJA

IUS-INFO - Postupak izvršenja presuda Europskog suda za ljudska prava pred domaćim tijelima


Republika Hrvatska stranka je Konvencije za zaštitu ljudskih prava i temeljnih sloboda od 5. studenog 1997.
Ratifikacijom Konvencije i priznavanjem jurisdikcije Europskog suda za ljudska prava u svim predmetima koji se tiču tumačenja i primjene Konvencije, Republika Hrvatska prihvatila je međunarodnu obvezu primjenjivati Konvenciju i pravne standarde koje u svojoj praksi izgrađuje ESLJP u postupcima pred domaćim tijelima, ali i obvezu izvršiti konačnu presudu ESLJP-a u kojoj je utvrđena povreda Konvencije.
Presude ESLJP-a obvezuju državu na koju se odnose. Za izvršenje konkretne presude ESLJP-a nadležno je ono državno tijelo koje je svojim radnjama ili propuštanjem uzrokovalo povredu Konvencije u konkretnom slučaju, ali i tijelo u čiju nadležnost ulazi neko od pitanja koje je presudom ESLJP-a označeno kao jedan od uzroka povrede Konvencije.
