VERIZON COULD BACK OUT OF YAHOO DEAL

Daily Rundown ImageVerizon is reportedly reconsidering its $4.8 billion purchase of Yahoo.

Yahoo announced Wednesday that 1 billion account credentials had been stolen going back to 2013, and the telecommunications giant is apparently considering canceling the entire acquisition.

Verizon could also decide to try to reduce the purchase price that it agreed to back in July.

Even though Ikea made headlines this week for its parental leave policy (Starting Jan. 1, Ikea’s 14,000 salaried and hourly workers in the U.S. will receive up to four months of paid parental leave. The policy applies to mothers and fathers who are birth, adoptive, or foster parents, and is a major improvement over their old policy.) But that company is a rarity as according to a new OfficeTeam survey, just under half (49 percent) of HR managers said their organization has made policy changes to better accommodate working parents in the past five years. Employees named flexible hours (79 percent) the family-friendly perk that would have the greatest impact on their decision to join a company. Sixty-eight percent of HR managers said their organization provides this option. Find out more here

A designated amount of money just for going out and buying silly things for yourself.

Who doesn't love a good horrible misspelling of their name on a Starbucks cup? It's kind of become a thing. I got Maridan last week and frankly I am just thinking of changing my name to that. But while we think this has been such a great joke, it turns out the joke is on us. According to a recent YouTube clip that proposed the theory (and all the best theories come from videos on YouTube of course) we are now asking the question: Is Starbucks misspelling your name on purpose? Think of how much advertising we give that company every time we snap and post a picture of Jennifer spelled with a Gh? We thought we were clever, but really we were just cogs in the Starbucks machine! Technically we are always advertising for Starbucks every time we walk around holding one of their cups (plus I also always carry a sign that says 'I Love Starbucks.') But the company must truly be run by masterminds as is evident in their latest drink which has now convinced us that fruitcake is actually cool and delicious. Fruitcake! The tofurkey of Christmas!

When I was younger, I fell in love with the Internet. I remember that moment of awe when I discovered something new and cool — when I hacked the code on my MySpace page to do something that made my friends want to copy it.

My name is Brenda Hernandez. I work for the Mozilla Leadership Network with Hive Chicago as an educator, a youth and community leader. I'm going to ask you to donate to Mozilla today to help support our work. If you'll give me a second of your time, I'll tell you why.

Kids today are born into the Matrix. I got to decide what pill to take. They didn't.

Because I'm of a generation just slightly before the Internet was everywhere, I learned how to decide if I want to live within the Internet. Or if I want to jump out and take a break.

Too many young people today don't have that luxury. The culture they're growing up in can best be described as FOMO — Fear Of Missing Out.

FOMO means young people today place so much value on their online identities. These identities aren't always real. Who are they? Where does their self-worth come from? Is it likes on Instagram? Or good grades in school? Or good deeds in their neighborhood?

I fear fewer and fewer kids are makers online today. We need our next generations to understand how to think critically, to understand what's real and what's not online, to make new things and grow, to inspire themselves and others, and push the direction of the Internet. We need them to do this so they understand their self-worth isn't tied up only in selfies and likes.

The Internet is a remarkable tool that touches and changes nearly every element of our lives. That is awesome. That is why Mozilla works to build an Internet that is innovative and open to everyone. But that is also why it has become so important to teach kids the skills they need to engage online, so that they can become the next generation of makers and builders.

I care about young people, I care about their future, and I care about the future of the Internet.

That is why I hope you will support our work here at Mozilla with a donation today. Plenković s Bidenom vrlo načelno razgovarao o blokadi Srbije

Hrvatski premijer, Andrej Plenković, izjavio je da s američkim potpredsjednikom, Joem Bidenom, nije konkretno razgovarao o blokadi srbijanskih pregovora s EU-om, nego o tome kako Hrvatska može pomoći zemljama jugoistočne Europe na putu u EU i NATO.
 

Petrov za promjene Ustavnog zakona o Ustavnom sudu

Predsjednik Hrvatskog sabora, Božo Petrov, izjavio je kako bi Hrvatski sabor trebao postići određeni stupanj suglasnosti i pristupiti promjenama 
Ustavnog zakona o Ustavnom sudu, osobito u dijelu koji se odnosi na postupak izbora sudaca Ustavnog suda.
 

Vlada usvojila stajališta za sastanak Europskog vijeća

Vlada je na zatvorenom dijelu sjednice usvojila stajališta za sastanak Europskog vijeća, 15. prosinca 2016. i stajalište za sastanak Vijeća za okoliš (ENVI), 19. prosinca 2016., te donijela niz odluka o razrješenjima i imenovanjima.

Zakon o ovlasti Vlade Republike Hrvatske da uredbama uređuje pojedina pitanja iz djelokruga Hrvatskog sabora

Ovlašćuje se Vlada Republike Hrvatske da uredbama uređuje pitanja tekuće gospodarske politike iz djelokruga Hrvatskog sabora, osim izmjena državnog proračuna i propisivanja poreza te onih pitanja koja prema Ustavu Republike Hrvatske može uređivati samo Hrvatski sabor, u razdoblju:
– od 15. prosinca 2016. do 15. siječnja 2017. i
– od 15. srpnja 2017. do 15. rujna 2017.
Zakon je stupio na snagu 10. prosinca 2016.
 

Opći porezni zakon

Zakonom se uređuju odnos između poreznih obveznika i poreznih tijela koja primjenjuju propise o porezima i drugim javnim davanjima ako posebnim zakonima o pojedinim vrstama poreza i drugim javnim davanjima nije uređeno drukčije i predstavlja zajedničku osnovu poreznog sustava.
Zakon stupa na snagu 1. siječnja 2017.
 

Zakon o Poreznoj upravi

Zakonom se uređuju poslovi i unutarnje ustrojstvo Porezne uprave, ovlasti, prava, obveze i odgovornosti službenika i namještenika Porezne uprave te sredstva za rad i stručno usavršavanje službenika.
Zakon stupa na snagu 1. siječnja 2017.
 

Zakon o porezu na dohodak

Porez na dohodak utvrđuje se i plaća prema odredbama ovog Zakona.

Zakon o lokalnim porezima

Zakonom se uređuju utvrđivanja i naplate lokalnih poreza kao izvora financiranja jedinica lokalne i područne (regionalne) samouprave.

Zakon o porezu na promet nekretnina

Porez na promet nekretnina obračunava se i plaća prema odredbama ovog Zakona.

Zakon o porezu na dobit

Izmjenama i dopunama Zakona se, među ostalim, propisuje da se porezna osnovica poreznog razdoblja iz stavka 8. članka 1. dodatno:
a) uvećava za:
1. rashode (gubitke) od vrijednosnih usklađenja dugotrajne materijalne i nematerijalne imovine
2. rashode (gubitke) od vrijednosnih usklađenja financijske imovine
3. rashode vrijednosnog usklađenja potraživanja od kupca za isporučena dobra i obavljene usluge
4. rashode od rezerviranja
5. rashode od nerealiziranih tečajnih razlika
6. rashode od ostalih nenovčanih transakcija
7. smanjenja potraživanja od poslovnih aktivnosti
8. smanjenja kratkotrajnih potraživanja po osnovi kamata priznatih u prihode
9. smanjenja zaliha
10. povećanja kratkoročnih obveza od poslovnih aktivnosti
11. povećanja kratkoročnih obveza po osnovi kamata priznatih u rashode
12. ostale korekcije koje povećavaju dobit i
b) umanjuje za:
1. prihode od vrijednosnih usklađenja financijske imovine
2. prihode od rezerviranja
3. prihode od nerealiziranih tečajnih razlika
4. prihode od ostalih nenovčanih transakcija
5. povećanja potraživanja od poslovnih aktivnosti
6. povećanja kratkotrajnih potraživanja po osnovi kamata priznatih u prihode
7. povećanja zaliha
8. smanjenja kratkoročnih obveza od poslovnih aktivnosti
9. smanjenja kratkoročnih obveza po osnovi kamata priznatih u rashode
10. ostale korekcije koje smanjuju dobit.
Izmjene i dopune stupaju na snagu 1. siječnja 2017.
 

Zakon o porezu na dodanu vrijednost

Izmjenama i dopunama Zakona se, među ostalim, propisuje da porezni obveznik ne može odbiti pretporez za nabavu dobara i usluga za potrebe reprezentacije pri čemu se reprezentacijom smatraju izdaci za ugošćivanje poslovnih partnera, darivanje poslovnih partnera, plaćanje poslovnim partnerima izdataka za odmor, sport i razonodu, izdataka za najam automobila, plovila, zrakoplova, kuća za odmor i slično.

Uređenje zabrane pušenja na radnom mjestu i sankcije za neposlušne radnike

U članku se razmatraju moguće sankcije za ponašanje radnika - pušača koji unatoč zabrani pušenja na radnom mjestu nastavljaju pušiti ne mareći za pravila i upozorenja poslodavca.
 

Povreda prava vlasništva kod oduzimanja vozila bez pravne osnove

Pitanje oduzimanja pokretnina (najčešće vozila) u upravnim i kaznenim postupcima te pitanje prava na naknadu za takvo oduzimanje (ako pravna osnova kasnije otpadne), u sudskoj praksi je jasno. 
No, posebno je pitanje kako postupiti u slučajevima tranzicijsko-ratne prirode u kojima je do oduzimanja došlo bez pravne osnove. Stoga prikazujemo dvije odluke Ustavnog suda kojima je utvrđeno kako razmatrati takve tužbene zahtjeve.
 STRUČNI ČLANAK

Spoznaja prave istine o stvarnoj šteti počinjenoj kaznenim djelom

Šteta pričinjena počinjenjem kaznenog djela nije primarni fokus kaznenog postupka, ali nesporno je neodvojivo povezana s njegovom provedbom. Utvrđivanjem kaznene odgovornosti počinitelja, nameće se i pitanje naknade štete počinjene kaznenim djelom. Prethodno je potrebno utvrditi stvarnu štetu počinjenu kaznenim djelom kao i odvojiti štetu od imovinske koristi.
Nastavno, počinitelji često osporavaju iznos štete, poglavito kod šumskih krađa, otuđenja zlatnine i drugih vrjednijih predmeta jer smatraju da oštećenici preuveličavaju štetu neobjektivno je procjenjujući na temelju subjektivne vrijednosti stvari.
 

Dokazna sredstva za utvrđivanje identiteta nekretnina

U sudskim postupcima u kojima se odlučuje o pravima na nekretninama i u kojima o tim pravima između stranaka postoji spor, potrebno je utvrditi identitet nekretnina. U praksi je najčešće riječ o parničnim postupcima radi utvrđenja prava vlasništva i o pojedinačnim zemljišnoknjižnim ispravnim postupcima.
Pitanje koja će dokazna sredstva biti korištena u svrhu utvrđenja identiteta nekretnina značajno je i s obzirom na dužnost suda da utvrdi činjenice važne za odluku o zahtjevima stranaka, ali i na dužnost provedbe postupka bez odugovlačenja, u razumnom roku i sa što manje troškova.
Najpouzdanije dokazno sredstvo za utvrđivanje identiteta nekretnina je uviđaj uz sudjelovanje sudskog vještaka geodetske struke. Ipak, mogućnosti koje pruža suvremena informatička tehnologija otvaraju dvojbe u praksi smiju li se i trebaju li se, u kojoj mjeri i na koji način u sudskim postupcima koristiti i te mogućnosti.
U ovom članku pokušava se dati odgovor na to pitanje.

Pravo regresa jamaca u postupku predstečajne nagodbe

Jamci dužnika nad kojima je otvorena predstečajna nagodba, svoje dospjele i nedospjele tražbine koje imaju prema dužniku ovlašteni su ostvariti u postupku predstečajne nagodbe - Županijski sud u Varaždinu, broj odluke Gž-1482/16-2 od 
27. listopada 2016. 
 

Primjena materijalnog prava

U postupku oporezivanja primjenjuju se porezni propisi koji su bili na snazi u vrijeme nastanka činjenica na kojima se temelji oporezivanje - Vrhovni sud Republike Hrvatske, broj odluke Rev 538/08-5 od 6. travnja 2011.

Savjetovanje Dani hrvatskoga insolvencijskog i ovršnog prava, održano u siječnju 2016., zahvaljujući vrhunskim pravnim stručnjacima koji su predstavili aktualne teme vezane uz stečajni, predstečajni i ovršni postupak te stečaj potrošača kroz zakonske propise Republike Hrvatske i relevantnu sudsku praksu, izazvalo je veliki interes sudionika.
Stoga i godinu dana poslije, u trenutku kada se gospodarstvo Republike Hrvatske ipak polako oporavlja, ali mnogi problemi u primjeni stečajnih i ovršnih propisa i dalje postoje i usporavaju normalno i učinkovito poslovanje, na savjetovanju istog naslova cijenjeni pravni stručnjaci iz područja pravosuđa, uprave i gospodarstva predstavit će aktualne teme vezane uz stečajni, predstečajni i ovršni postupak te dati praktične smjernice za postupanje uz primjere iz sudske prakse.

Sudionici savjetovanja imat će mogućnost postavljati pitanja predavačima.
Na pitanja će biti odgovarano nakon završetka predavanja pojedinih predavača. Pitanja u pisanoj formi mogu se predati organizatoru savjetovanja prije kraja predavanja na koja se odnose. U slučaju većeg broja pitanja moguće je manje odstupanje od predviđenog programa savjetovanja.
