Sabor danas o izmjenama Ovršnog zakona

Hrvatski sabor današnju sjednicu nastavlja raspravom o 
Konačnom prijedlogu izmjena Ovršnog zakona, koji je predložio Klub zastupnika Mosta, koji je Vlada prihvatila i na njega podnijela svojih 13 amandmana. 
Prema Konačnom prijedlogu, više se neće moći provoditi ovrha na jedinoj nekretnini kada je vrijednost glavnice manja od 20 tisuća kuna.
 

Za ustavne suce predloženi Šeparović, Arlović i Selanec

Saborski Odbor za Ustav i Poslovnik predložio je, bez rasprave, Hrvatskom saboru da za suce Ustavnog suda izabere Miroslava Šeparovića, Matu Arlovića i Gorana Selanca. Predložio ih je s 11 glasova za i jednim suzdržanim, onim Mostova zastupnika Roberta Podolnjaka.
 

GSV o rastrećenju poduzetnika i Pravilniku o evidenciji radnog vremena

Ministar rada i mirovinskog sustava, Marko Pavić, izjavio je nakon sjednice Gospodarskoga socijalnog vijeća (GSV) da su, među ostalim, razgovarali o akcijskom planu za rasterećenje poduzetnika i da je u vezi s Pravilnikom o evidenciji radnog vremena bilo određenih razilaženja.


Sud vratio na doradu optužnicu protiv bivše ravnateljice Hrvatske lutrije

Zagrebački Županijski sud vratio je tužiteljstvu na doradu optužnicu protiv bivše direktorice Hrvatske lutrije, Vesne Bakran, koju zagrebačko Županijsko državno odvjetništvo tereti zbog sklapanja nezakonitih ugovora s marketinškom agencijom Fimi media.

Povjerenik za ljudska prava Vijeća Europe, Nils Muižnieks, zatražio je od hrvatske Vlade da ponovno razmotri nacrt Zakona o pravobranitelju za djecu te da razmotri amandmane koji su na prijedlog Zakona uputili pučka pravobraniteljica i pravobraniteljica za djecu.

Ministarstvo uprave RH raspisalo je javni natječaj za imenovanje predstojnika/ice ureda državne uprave u 16 županija, objavilo je Ministarstvo na svojim internetskim stranicama.
 

Vrhovni sud i novi slučaj protiv Mamića preselio u Osijek zbog njegova poznanstva sa sucima

Poznanstvo sa sucima zagrebačkog Županijskog suda, ali i predsjednicima Županijskih sudova u Zagrebu, Rijeci i Splitu razlog su što je predsjednik Vrhovnog suda, Branko Hrvatin, odobrio prijedlog glavnog državnog odvjetnika, Dinka Cvitana, da se i druga optužnica protiv čelnika Dinama Zdravka Mamića podnese pred osječkim Županijskim sudom.

Zakon o subvencioniranju stambenih kredita​

Zakonom se u svrhu poticanja demografske obnove društva, urbane regeneracije naselja te smanjenja iseljavanja mladih obitelji i pomoći građanima uređuje subvencioniranje stambenih kredita koje građani uzimaju od kreditnih institucija za kupnju stana ili kuće odnosno gradnju kuće radi rješavanja svojeg stambenog pitanja.
Zakon stupa na snagu 15. srpnja 2017.
 

Zakon o prostornom uređenju  

Izmjenama i dopunama Zakona se, među ostalim, propisuje da se u prostoru ograničenja ne mogu osnivati nova naselja, odrediti novi izdvojeni dijelovi građevinskog područja naselja, a postojeći izdvojeni dijelovi građevinskog područja naselja ne mogu se proširivati u pojasu od 100 m od obalne crte.
Izmjene i dopune stupaju na snagu 15. srpnja 2017.
 

Zakon o postupanju s nezakonito izgrađenim zgradama 

Izmjenama i dopunama Zakona se, među ostalim, propisuje da nadležno upravno tijelo može u svrhu obavljanja poslova vezanih uz donošenje rješenja o izvedenom stanju zaposliti na određeno vrijeme službenike na rok do tri godine.
Izmjene i dopune stupaju na snagu 15. srpnja 2017.
 

Pravilnik o izobrazbi u području javne nabave

Pravilnikom se propisuju program izobrazbe, planiranje, način provedbe izobrazbe, način izdavanja i obnavljanja certifikata te druga bitna pitanja u vezi s izobrazbom u području javne nabave.
Pravilnik stupa na snagu 15. srpnja 2017.
 

Pravilnik o dokumentaciji o nabavi te ponudi u postupcima javne nabave

Pravilnikom se utvrđuju sadržaj, način izrade i postupanje s dokumentacijom o nabavi, sadržaj, način izrade, dostava i postupak zaprimanja ponuda i zahtjeva za sudjelovanje, postupak otvaranja ponuda, sadržaj, način izrade i dostave zapisnika o otvaranju ponuda, zapisnika o pregledu i ocjeni ponuda, zapisnika o pregledu i ocjeni zahtjeva za sudjelovanje, zapisnika o vođenju pregovora i zapisnika o vođenju dijaloga i druga bitna pitanja u vezi s dokumentacijom o nabavi, ponudom, zahtjevom za sudjelovanje, otvaranjem ponuda i zapisnicima u postupcima javne nabave te u slučaju nabave društvenih i drugih posebnih usluga kao i postupanje u slučaju nedostupnosti Elektroničkog oglasnika javne nabave Republike Hrvatske.

Pravilnikom se propisuju sadržaj i oblik predstavke kojom se traži provedba upravnog nadzora, sadržaj zapisnika o provedenom nadzoru te druga pitanja u vezi s provedbom nadzora.

Diskriminacija putem Pravilnika - marama kao religijski simbol

Sud Europske unije nedavno je odlučivao o internom Pravilniku jednog belgijskog poduzeća kojim je radnicima zabranjeno nošenje vidljivih simbola političke, vjerske ili filozofske naravi na radnom mjestu i vršenje svih obreda povezanih s tim uvjerenjima.
Pitanje koje je postavljeno Sudu Europske unije odnosilo se na jednako postupanje, odnosno je li sadržajem spomenutog Pravilnika došlo do diskriminacije na temelju vjere ili uvjerenja te posljedično do neizravne diskriminacije u konkretnom slučaju.


Plaćanje poreza na promet nekretnina kod razvrgnuća suvlasničke zajednice

Sukladno Zakonu o vlasništvu i drugim stvarnim pravima, suvlasnik ima pravo na razvrgnuće suvlasništva, ako je moguće i dopušteno, i to mu pravo ne zastarijeva. U praksi je postavljen upit o obvezi plaćanja poreza na promet nekretnina kod razvrgnuća suvlasničke zajednice u slučaju kada neki od suvlasnika razvrgnućem stekne nekretnine ili dijelove nekretnine, a drugi dobije isplatu u novcu.

Privremeno udaljenje radnika s posla prema Zakonu o radu

Privremeno udaljenje radnika s posla prema Zakonu o radu (NN 93/14) je institut kojim se, s jedne strane, štiti nesmetano odvijanje poslovnog procesa i interesi poslodavca, a s druge strane ograničava se radnikovo pravo na rad i pravednu naknadu za rad.
U radu se, među ostalim, daje detaljan prikaz uređenja ovog instituta te skreće pozornost na podnormiranost s ciljem uklanjanja postojećih nedostataka i uvođenja novog zakonodavnog okvira koji bi zadovoljio interese obiju strana u radnom odnosu.
 

Odgovornost organizatora javnih sportskih priredbi za štetu nastalu gledateljima

U radu se prikazuje tko se sve može pojaviti kao organizator javne sportske priredbe, a poseban naglasak je na protupravnim ponašanjima kojima se može prouzročiti šteta gledateljima.
Neovisno o svim posebnostima, prema sadašnjem stanju zakonodavstva i sudske prakse, organizator javne sportske priredbe odgovara za štetu gledateljima prema Zakonu o obveznim odnosima i to samo za štetu koja nastane kao posljedica smrti ili tjelesne ozljede.

Predmet spora

Ako je predmet spora raskid ugovora o ortaštvu i isplata, tada drugostupanjski sud nije dužan povodom žalbe tužitelja razmatrati pitanje ništetnosti tog ugovora - Vrhovni sud Republike Hrvatske, broj odluke Rev 1601/11-2 od 10. rujna 2013.
